A new week, another plagiarism scandal.

Usually, it’s big companies being accused of ripping off independent designers and influencers like Felicity Hayward calling out Shein for taking her logo or Topshop stealing designs from art school students.

This time around, it’s a swimwear label accusing Emily Ratajkowski of plagiarism.

Business of Fashion reports that Lisa Marie Fernandez has sent the model a cease and desist letter following the launch of her new swimwear line, Inamorata.

The pieces causing all the fuss are an off-the-shoulder bikini and a strapless swimsuit which knots in the front.

Lisa claims that they’re suspiciously similar to her Leandra and Triple Poppy styles launched three years ago.

According to BoF, representatives for Emily and Inamorata Swim declined to comment.

In the states, there’s no copyright protection for functional things like clothing but as Inamorata Swim ships internationally, Lisa has been able to invoke two European Union Community Design Registration certificates that she registered in May 2015.

And that means she’s able to supply, import, export or deal in products incorporating the design within the EU until 2020.

‘Because of technology, we are really entering an era of accountability in so many ways,’ Lisa says about the similarities between the designs on Instagram.

It’s not actually Lisa’s first time having to chase brands either.

She’s previously sent cease and desist letters to H&M and has had retailers like Solid & Stripe and Cotton On remove items she claimed were copied.

‘(Copying) is constant and we are going full force with it,’ she says.

She’s given Inamorata until 22 November to respond to her letters before she starts legal proceedings.
