The West Virginia Senate voted Friday in favor of a resolution that would allow the state government to restrict access to abortion by asserting the procedure is not and should not be a constitutional right.

The state Senate voted Friday to pass Senate Joint Resolution 12, which states “nothing in this Constitution secures or protects a right of abortion or requires the funding of abortion,” according to the Charleston-Gazette Mail.

“At Students for Life of America, we know that Roe v. Wade will someday be overturned, and so do the legislators in West Virginia. This effort to be ready to protect life at the state level after Roe falls in court is exactly the kind of ground game that policy leaders should be championing across the country,” Students for Life of America president, Kristan Hawkins, told The Daily Caller News Foundation in a Friday statement. “We applaud West Virginia legislators for getting organized to put this before the voters,” she added.

Others don’t think so highly of the resolution and see it as an attack on women’s rights. “This is not an issue about women’s health, it’s about a political play. They are playing politics with women’s health care,” said Planned Parenthood South Atlantic director of public affairs Alisa Clements in a statement. “They’re making this a fight against poor women in West Virginia, it’s politically driven,” she added.

“We think it was the wrong ruling,” said Senate President Mitch Carmichael, who thinks the proposed constitutional amendment is intended to undermine Roe V. Wade according to WVNews.

In 2015, the West Virginia’s legislature passed a law banning abortions after 20 weeks gestation. It also passed a law in 2016 making it illegal for physicians to perform dilation and extraction abortions.

House Bill 4012 will now head to the House for a full vote.
