California Homeowner Wont Sell To Trump Supporters — But That Might Be Illegal

A Sacramento woman has put a family home on the market and she wants the realtor to ensure that it isnt sold to a supporter of President Donald Trump.

The home has been in Linda Morgans family for decades, and although she told the local CBS affiliate that she is open to people from all walks of life, Morgan says that openness stops at political preference.

Attorney Allen Sawyer told the network that he believes the stipulation to be illegal. “Thats an unlawful contractual term that infringes the freedom of association and first amendment rights. People have a right to believe what they want to believe and they shouldnt be restricted from purchasing property based on that.”

The Fair Housing Act lists “race, color, national origin, religion, sex, disability and the presence of children” as reasons homeowners are prohibited from refusing to sell or rent, but it does not mention political preference.

Fox News contributor Bob Massi, host of “The Property Man,” told Fox News that it could be legal under federal law. “Under federal law, its legal, yes. California has a specific law, a civil rights law that in fact this could be a violation. The federal law, I actually, to be candid with you, I emailed Judge Napolitano because hes so brilliant in this area, to make sure that what I was seeing I was seeing. Theres no doubt that under the California law there could be a problem for this woman.”

Realtor Elizabeth Weintraub told CBS that there may also be an easy out for potential buyers. “We can ask somebody how they voted, but they dont have to tell us.”

Since 33.8 percent of Sacramento County voted for Trump in the 2016 election, the locals may want to consider that advice.
